       The background of the matter leading up to your request is briefly
   net out below.

       Approprintiins for dopnrtn--nto and agencies whose fiscal year 1973
   annual npproprLation act had not be  enacted into law so of July 1,
   1972, ware provided by the so-called Continuins fReaolutton, Pub, L. 92-
   334, approved July 1, 1972, 05 Sta. 402.

   a   Since no annual appropriation act was enacted for fincnl year 1973
   for the Depnrt:munt of calth, Eduction, and Welfare (imU1) the oblign-
   tiono and e:rcnditures of the Dpartment werae ovorned by the provinioni
   of the Continuits iRenolution, as amended, during the entire fiucal year.

       Under such circumstance, funds available for the irpact aid program
  tere required to be apportio-aed to educational agencies in a it.inner co
  as not to dinti-ntdah bt±wen section 3(b) student under Pub. L. 01-
  874-.-children whoso parents reside or are employed on Federal property-
  and coction 3(a) otudents--children whose parents reside on and are
  employed on Federal property.

       However, Pub. L. 93-25, approved April 26, 1973, 87 Stat. 26, mking
  supplemental nppropriationa for certain agencies, coatains the following
