          Centlemen:

               This is in reply to your telegram of February 2, 1973, and
          subsequent correspondenre, protesting on behalf of Dre:el
          Industries, Incororated, azatnst the award of a contract to
          any other firm by the Defense 'upily AMency under invitation
          for bids (IFli) lbo. DSA700-73-e-1446, issued by the Defense
          Construction wupply Center, Columbuv# Ohio.

               The solicitation was for 13 forklift trucks to be used for
          shipboard missile handling by the United States Narl.   At bid
          opening on Ja.uary 31, 1973, i'. twas found that W0sterui Gear
          Corporation b'.d $36,893 per trutkit hile Drexel, the only other
          bidder, bid $48,500 per truck.  Drc:,,ol protested any award to
          Western Gear, however, because of :'ootorn Gear's failure to
          submit a first article test report under a previousl awarded
          contract for 62 forklift truchs similar to thise called for by
          the instant IFf. Award has-'not been made.

               Contract INo, DSA700-71-C-8662 was awarded to Western Gear
          on June 3, 1971, and .required the submission of a first article
          test report by February 29, 1972,  Drexel protested this award,
          alleging, inter alto, that lyestern Gear would not be ohIs to
          perform and would not ,eeE the date for firot article testing.
          Although Western Gear did not cubmit a first article test
          report by the required date, we closed our file on thL protest
          because we viewed the matters in issue as prinarily involving
          contract administration responsibilities.  B-173195, fay 4, 1972.
