       Dear r. liggins:

           We refer further to letter of June 18, 19730 wherein Mr. Michael E
       Goldmaun, your designated representativo in matters before our Office,
       set forth yourclaim for overtime pay while in a travel etatuejand per
       diem during temporary duty incident to tha floods caused by Hurricnne
       Agnes, lr, Goldman states that his letter constitutes an appeal of
       the decision by Hr, Alfred L, Whinstont District Director, Pniladelphta
       District, ntecnal Revenue Service (IRS), denying your request for
       overtime pay whila In a travel status and per diem while assigned to
       tomporary duty.

           The questions presented arose after you were assigned tempcrtrily
       on July 5, 1972, to the Office of Emergency Preparedness (OEP) dun to
       the flooda cauaed by Hturricme Agnes and told by your suporv .sor at IRS
       to report to te person In charge of the 0P office at the H-facken School
       and perform such dutins as directed during the hours designated by OEP.

           With rZ'grnce to the period July 5, 1972, to April 14, 1973, the
       letter stateg:

                ' * * Hlr. lggins remained at the Macken School from
           July 5 throlgh July 7, 1972. On July 5, 1972, ie fliggins
           loft his hca* at 8:00 a.m. and returned at 9:00 p.m. On
           July 6, 1971, he departed from his home at 730 a.m. and
           returned at 9:00 p.m. and on July 7, 1972, he left at
           7:30 a.m, a.d returned at 10:00 p.m. Mr. Hliggins was
           required o'. travel 12 miles from his home to this temporary
           post of duty.

                On July 7, 1972, Mr. Higgins wat directed to report
           to the OXP office located at the Blooneborg State College
           campus.  Hr.. lliigins worked there until July 10, 1972. On
           July 8, 1972, fir. Higgins departed his home at 6:30 a.m.
           and rotutinwd at 10:00 p.m.; on July 9, he departed at
