We were furnished copies of deferrals which the ':-'-o ;Aent sul-mitted
to the Congress on September 24 in his fourth special :' ssece for fiscal
year 1976 pursu nt to the Impoundment Control Act of 1974. 11e special
message transmits three new deferrals. The Presiden' zriau-ts that the
impoundments wIli reduce fiscal year 1976 outlays by (6.2 :1l.o,-. Enclo-
sure I su ari:,e:, by agency, the total budget autho ,ty an,! FY ]_976 outlay
reductions involved in the message.
The lhpoun W5 nt Control Act requires us to revie. achi ra s,,e and
report promptly to the House and Senate as to the facts, surroincling ench
action, including the probable effect thereof, and in thc casc of deferrals,
to render a ji'gLn,-t as to whether the action is in a-eordance with existing
leg ,l authority. Lnclosure II cootains our comments oa each impol'Idment
tr;irismitted by the ]'rcsidcnt's Sep, aber 24 special message.
One of the proposed deferrals, D76-55, is a deferral of budget authority
that was the subject of a prior proposed rescission special message (R76-1)
which was rejected by Congress therefore requiring the funds to be released.

result in at cast C() million of tLh: budget authority opsing en June 30,
1976: in effc,'t o;i':e the Executie Branch to rescind budgeL authority
without the cons;ent of the Congress as a whole.
We belleve the Act does not provide authority in this particular case
for the President to submit a deferral message following rejection by the
Congress of a rescission proposal for the same funds, but since the deferral
is offered in respos.c to the express wishes of the Appropriations Cu,mittees
of the Congress, ve plan no action pending further congressional actions.
