Resources, submitted the following
REPORT

The Committee on Energy and Natural Resources, to which was
referred the bill (H.R. 2786) to amend the Federal Power Act with
respect to the criteria and process to qualify as a qualifying conduit
hydropower facility, having considered the same, reports favorably
thereon with an amendment, and recommends that the bill, as
amended, do pass.
AMENDMENT
The amendment is as follows:
On page 2, strike lines 7 through 12 and insert the following:
(2) in paragraph (3)(C)(ii), by striking 5 and insert-
ing 40.
PURPOSE
The purpose of H.R. 2786 is to amend the Federal Power Act
(FPA) with respect to the criteria and process to qualify as a quali-
fying conduit hydropower facility.
BACKGROUND AND NEED
The Hydropower Regulatory Efficiency Act of 2013 (Public Law
113-23) amended the FPA to allow FERC to issue exemptions
(which are licenses granted in perpetuity) for hydroelectric projects
of five megawatts or less utilizing manmade conduits that are oper-
ated primarily for purposes other than electricity generation.
