Q&A Comments Address Fund Issues
Bar Members To Vote On Special Annual
Assessment For Clients' Indemnity Fund
The following story includes a brief history of the Bar Association's Clients'
Indemnity Fund and provides contrasting views on whether the legal profession
is responsible to compensate parties who suffered financial losses due to a; torney
dishonesty. Bar News presents the viewpoints of two Bar members, one in
support of a proposed annual assessment and one against an assessment, in
advance of a Bar member vote on a recommendation that a five-year annual
assessinent be made to all (active and inactive) Bar members to increase the
balance of the Clients' Indemnity Fund.
According to its enacting resolution, the Bar Association's Clients' Indemnity
Fund, created in 1960, was established for reimbursement, in whole or in part, to
clients of New Hampshire lawyers of losses sustained by them by reason of the
embezzlement, conversion or theft by New Hampshire lawyers of money, funds,
securities or property belonging to their clients or held by the lawyer as a
fiduciary... In accordance with the Fund's Rules of Procedure, the Clients'
Indemnity Fund will not entertain claims for reimbursement until the claimant
has shown that all reasonable legal and other avenues against all potential
obligers on the claim have been exhausted.
Prior to any reimbursement through the Fund, claimants must execute a
subrogation agreement in favor of the Fund against the offending lawyer.

Bar Foundation Seeks
Nominees To Serve
On Grants Committee
The New Hampshire Bar Foun-
dation is seeking nominees to run for
one five-year seat on the Interest on
Lawyers Trust Accounts IOLTA
Grants Committee. The five-member
Grants Committee receives and
reviews requests from programs
providing legal services to the
disadvantaged and public information
about the courts and the law. The
committee makes annual funding
recommendations to the board of
directors of the Bar Foundation.
The deadline for nominations is
June 24. Ballots will be mailed out by
July 14 and will be due back by July
29. The five-year term is scheduled to
start immediately after the election
