An Act to Amend Chapter 84 of the General Statutes
of North Carolina Relating to the North Carolina State Bar

The General Assembly of North Carolina enacts:
Section 1. Chapter 84 of the General Statutes of
North Carolina is hereby amended by striking the
remainder of the first sentence of G.S. 84-2 following
the word shall in the fourth line and inserting in
lieu thereof the words engage in the private practice
of law. and by amending G.S. 84-16 in the fourth
paragraph thereof by striking out the first word
'only and inserting in lieu thereof the word all.
Sec. 2. Chapter 84 of the General Statutes is
hereby amended by adding a new section
immediately following G.S. 84-23.1, to be designated
as G.S. 84-23.2 and to read as follows:
G.S. 84-23.2, Additional Powers of the Council;
Client Security Fund; Fee Arbitration. (a) This section
is in addition to and not a limitation of the powers and
responsibility of the Council set out in G.S. 84-23. To
the extent that this section deals with the same
powers and responsibilities, it shall be taken to be in
amplification of those powers and not in derogation
thereof.
(b) The North Carolina State Bar Council is
authorized, but not required, in its discretion, to
establish a procedure for the reimbursement of
clients for actual losses sustained resulting from the
dishonest conduct of their attorneys. To accomplish
this purpose the Council is authorized to allocate
funds of the North Carolina State Bar to set up a
security fund to protect clients from such losses, or to
take such other action as it may deem appropriate to
carry out this purpose, which procedure shall be
subject to the approval of the Chief Justice of the
Supreme Court of North Carolina.
(c) The North Carolina State Bar Council is
authorized, but not required, in its discretion, to

establish a procedure for the resolution of fee
disputes between attorneys and clients which
procedure shall be subject to the approval of the
Chief Justice of the Supreme Court of North Caro-
lina.
Section 3. G.S. 84-34 as it appears in the 1979
Cumulative Supplement to Vol. 2c of the General
Statutes is amended by striking from line 3 the figures
1975 and inserting in lieu thereof the figures
1981, and by striking from line four the words and
figures of seventy-five dollars ($75.00), and
inserting in lieu thereof the words as shall be set by
rule the North Carolina State Bar Council,
promulgated under G.S. 84-21, and approved by the
Supreme Court of North Carolina.
Sec. 4. Chapter 712 of the 1977 Session is
amended in Section 2 thereof by striking out on lines
18 and 19 the words G.S. Chapter 84, Article 4,
entitled 'North Carolina State Bar' and Chapter 744
of the 1979 Session Laws is amended in Section 1
thereof by striking out on line 3 the words Chapter
84, Article 4, entitled 'North Carolina State Bar.'
which also appears and is stricken from line 42 of
G.S. 143-34.12 of the 1980 Interim Supplement of the
General Statutes of North Carolina which reads as
follows:
Chapter 84, Article 4, entitled 'North Carolina
State Oar'.
Section 5. All laws and clauses of laws in conflict
with this Act are hereby repealed.
Section 6. Except as herein otherwise
specifically provided, the provisions of this Act shall
become effective upon ratification.
