President
THANK YOU FOR THE PRIVILEGE, it has now become my turn to
review my year as president and to pass the gavel. I do so reluctantly
because so much work remains to be done. I also do so with a feeling of
nostalgia because of leaving the many lawyers who have been so dedicated
to the betterment of the legal profession during the year.
One of the highest compliments I can pay to my fellow lawyers is that
almost no member of the KBA failed to perform any task given to him or
her and it was performed well. The entire 3500 members of the KBA
should express their thanks to the Executive Council for their dedicated
efforts and giving hundreds of hours of valuable time to improve the
quality and image of the legal profession in Kansas.
Ken Klein, your Executive Director, Marcia Poell, your Public Relations
Director and Gary Robbins, your CLE Director and the entire staff of the
KBA have done a superb job despite crowded quarters and a burdensome
volume of work. We are all grateful to them for their loyalty.
I. THE LONG RANGE PLANNING COMMITTEE
The year has been busy and hopefully because of it, our profession has
profited. With the advent of the Long Range Planning Conference, we
have set the course for a continuous study and planning program to meet
future demands of our profession. The Executive Council has created a
permanent Long Range Planning Committee. It will be chaired by the
Honorable Terry Bullock and staffed by capable and dedicated lay persons
and lawyers. If utilized properly this can have great value for the future
image and effectiveness of the Kansas Bar Association.
II. FEDERAL INTERVENTION
This has been a year of many problems. It started off with Chief Justice
Burger accusing the legal profession of having only 25% competency. The
President of the United States said the country was plagued with being
over-lawyered -and under served, with 75% of our people being unable
to afford an attorney. These thrusts of criticism were the polestar to which
we sought reform and improvement. We were faced with various federal
programs designed to ultimately control and regulate the legal profession.
(1) The Federal Trade Commission
The Federal Trade Commission has taken the first steps in such control.
The government attorney in charge of this attempt openly advocates that
the FTC, through its existing rule making power, develop federal regula-
tions for the purpose of overriding and eliminating state regulations and
restrictions on the practice of law. The theory of the FTC is that the
development of legal clinics, group plans, storefront legal services, do it
