Alaska, 2023. Intro. Note quot. in ftn. (T.D. No. 1, 2018). State agency took emergency custody of an
infant directly from the hospital within days of the infant's birth and filed an emergency petition to
adjudicate the infant as a child in need of aid under a state statute, alleging that there were ongoing
concerns of domestic violence between the infant's parents and that it had previously assumed
emergency custody of the infant's two older siblings. After a hearing, the trial court dismissed, finding
no evidence that the infant had suffered substantial physical harm. Reversing in part and remanding, this
court held that the evidence was sufficient to establish probable cause to believe that the infant was a
child in need of aid due to substantial risk of substantial physical injury. The court cited the
Restatement of the Law: Children and the Law in explaining that it attempted to balance the private
interest in family autonomy with the state's interest in protecting children from harm when deciding
whether to terminate parental rights. Department of Family & Community Services, Office of Children's
