  C.A.7, 2018. Cit. generally in sup. In an action brought by trustee and trust beneficiary against financial
  advisor retained by a co-trustee and co-beneficiary, this court affirmed the district court's grant of
  defendant's motion for summary  judgment,  holding that plaintiff was precluded from suing in his
  capacity as trustee without consent from the majority of trustees, and, as a trust beneficiary, plaintiff
  could bring suit on behalf of the trust against a third party only where the trustees had breached a
  fiduciary obligation by not joining the suit, which plaintiff did not allege. The court noted that there was
  no choice-of-law issue that would be outcome-determinative, because both Illinois and South Dakota
  followed the Restatement of Trusts. Doermer v. Oxford  Financial Group, Ltd., 884 F.3d 643, 648.
