§ 1. Agency; Principal; Agent

D.Md.2017.  Subsec. (1) quot. in sup. Guatemalan victims of a human-research experiment conducted by
the United States and others, in which subjects were infected with sexually-transmitted diseases without
their knowledge or consent, sued, among others, Maryland entities that employed certain individual
experimenters, asserting claims under the Alien Tort Statute and Guatemalan law. This court denied in
part entities' motion to dismiss, holding that victims sufficiently alleged that the experimenters were
acting within the scope of their employment with and as agents of entities, rather than the United States
government, under agency principles set forth in the Restatement of Agency. The court reasoned, in
part, that the experimenters did not become federal employees as a result of serving on the advisory
panel to the government agency that authorized and oversaw the experiments. Estate of Alvarez v. Johns
Hopkins University, 275 F.Supp.3d 670, 693.
