CONFLICT OF LAWS
CHAPTER 7. PROPERTY
TOPIC 3. MOVABLES
TITLE F. SUCCESSION ON DEATH
§ 307. Revocation of Will of Movables
Fla.App.2023. Quot. in sup. After the appointment of decedent's daughter and son-in-law as personal
representatives of decedent's intestate estate and the later discovery of two wills that decedent had
executed in Louisiana in 2014 and 2015 before moving to Florida, decedent's domestic partner filed a
petition to admit the 2014 will to probate, alleging that the 2015 will was invalid under Florida law
because it was handwritten and unwitnessed. The trial court granted summary judgment for partner.
Noting that the parties had stipulated that the 2014 will was executed in accordance with both Florida
and Louisiana law, this court affirmed, holding that, under Florida law, the 2015 will could not be
recognized as a will or as an instrument revoking the 2014 will. The court cited Restatement of Conflict
of Laws § 307 in explaining that whether an act claimed to be revocation of a will was effective was
determined by the law of the forum in which the testator was domiciled, and the parties did not dispute
that decedent was domiciled in Florida at the time of death. Caveglia v. Heinen, 359 So.3d 745, 748.
CHAPTER 9. WRONGS
TOPIC 1. TORTS
§ 377. The Place of Wrong
U.S.2023. Cit. but dist. Russian creditor, who had obtained a California judgment confirming and
enforcing a London arbitration award against California debtor, sued debtor, bank that was located in
Monaco, and debtor's family members and accomplices in other countries, alleging that defendants
violated the Racketeer Influenced and Corrupt Organizations Act by transferring debtor's funds to bank
to frustrate plaintiff's attempt to collect on the judgment. The district court granted defendants' motion
