Discussion is not confined to the questions pre-
sented here. You are earnestly requested to raise any
further points which occur to you.
Section 290.
There is considerable authority against this; see
Hervey v. Locomotive Works, 93 U. S. 664.
This is believed to represent the prevailing and
sound view, but the question should be considered.
'Section 315.
The doctrine of this Section has been ably at-
tacked; and compare Sections 317A and 318. There
is difficulty in drawing the line between the legality
and the administration of a trust. Is experience in
practice in accordance with these Sections or to the
contrary?
Section 485.
On this point there has been some difference of
opinion. Professor Lorensen and the late Professor
Barbour have published opposite views. The author-
ities are represented by the cases of
Mallette v. Scherrer, 164 Wis. 415;
Fall v. Eastin, 215 U. S. 1.
