Questions Suggested for Discussion at
Ninth Annual Meeting
May 7-9, 1931
Discussion is not confined to the questions pre-
sented here. You are earnestly requested to raise any
further points which occur to you.
1. Should the interest of a debtor or that of the
creditor be preferred in a doubtful case of application
of payments ?
2. What is a conclusive application of payment by
creditor ?
3. May the debtor before his creditor has made a
formal application, direct the application of the pay-
ment?
4. How far are sureties favored in the application
of a payment made by a principal debtor who owes two
debts, for only one of which the surety is bound?
5. How general is rescission of an executed sale
allowed for breach of warranty?
6. Is there any difference in the methods by which
a sealed and an unsealed contract may be discharged ?
7. Is there any difference between the methods by
which a written and an oral contract may be dis-
charged?
