Questions Suggested for Discussion at
Eighth Annual Meeting
May 8-10, 1930
Discussion is not confined to the questions pre-
sented here. You are earnestly requested to raise any
further points which occur to you.
Draft of Contracts (Breach of Contract).
1. Under the definition of Breach of Contract, is a
breach ever excusable?
2. If, in pursuance of all oral contract to sell and
buy land, the pnrelaser is put into possession by the
vendor and makes substantial improvements, is the
subsequent refusal by the vendor to convey, a breach of
contract, within the definition?:
3. It an infant and an adult enter into a bilateral
contract, and while the contract remains wholly execu-
tory on both sides, the infant fails to perform his prom-
ise, is this a breach of contract?
4. If in Illustration 2, under Section 308 (page 14),
A in the third line is changed to C, is B's repu-
diation an anticipatory breach? In other words, is it
essential that the condition be one that only the prom-
isee can perform in order to make an anticipatory
breach possible?
