§ 5.01 Scope
Iowa.2023. Com. (a) quot. in disc. Wife filed marriage-dissolution proceedings against husband. After
the trial court ordered wife to pay husband $3,000 per month in rehabilitative spousal support for four
years, the court of appeals modified the award to require wife to instead pay $5,000 per month in
transitional support for seven years. This court reversed in part, holding that transitional support was
inappropriate, because husband had sufficient liquid assets to meet his immediate needs and that type of
support was typically awarded to help spouses for a short period of time to resolve a liquidity crunch
following a divorce; the trial court's order directing wife to pay rehabilitative support was consistent
with Iowa caselaw and was what husband needed to improve his skills and retool his business plan to
increase his income. The court cited § 5.01 of the Principles of Family Dissolution in noting that, while
the theoretical justification for the provision of spousal support had not been well-developed, Iowa
courts had explained that the amount and duration of a support award had to be tailored to achieve the
underlying purpose of the award. In re Marriage of Sokol, 985 N.W.2d 177, 184.
