Agricultural workers who were hired by strawberry growers filed a putative class action against fruit distributors, alleging that defendants were client employers that were liable under state labor statutes for growers' failure to pay plaintiffs' wages for picking strawberries that were delivered to defendants. The district court entered judgment for defendants. This court affirmed, holding that defendants were not plaintiffs' client employers, because plaintiffs did not work on land controlled by defendants. The court noted that the statute required the district court to determine whether defendants exercised sufficient control over the farmlands to make the lands their premises such that defendants could be considered plaintiffs' client employers; in contrast, the control test set forth in Restatement of Employment Law § 1.01 was used to determine whether an employer exercised sufficient control over workers for there to be an employment relationship.
