Relating to Sport Fish and Wildlife

The Acts listed here with brief descriptioris of their provisions are the authority for many activities of the
Department of the Interior through its Bureau of Sport Fisheries and Wildlife, but this is not a complete
listing of all Acts governing the work of this Bureau. The purpose of this leaflet is to provide a ready refer-
ence to the Federal conservation laws most commonly associated with the protection and management of wild
mammals, birds, fishes, amphibians, and reptiles. The statutes are listed chronologically by date of enactment,
and important amendments are noted. An exception to this arrangement is the group listing of specific
National Wildlife Refuge Acts, Fish Hatchery Acts, and Fish and Wildlife Conservation at Water Resources
Projects Acts. A representative sample of these specialized statutes is provided at the end of this listing. This
leaflet does not include the numerous Federal laws requiring consultation and coordination with or by the
Bureau of Sport Fisheries and Wildlife.

- 1900 to 1919 -
Lacey Act of 1900, as amended (16 U.S.C. 701).-Sec-
tion I states that the duties of the Department of the Interior
include conservation, preservation, and restoration of game
birds and other wild birds. Authorizes regulations for in-
troduction of American or foreign birds or animals into new
localities. Authorizes collection and publication of informa-
tion on wild birds.
Criminal Code Provisions (18 U.S.C. 42-44; derived
from Sections 2-4 of the Lacey Act of 1900).-Section 42
prohibits importation of wild vertebrates and other animals
declared by the Secretary of the Interior to be injurious to
man, agriculture, wildlife resources, etc., except under cer-
tain circumstances and pursuant to regulations. Section 43,
as amended in 1969, prohibits shipping, transport, sale, or
purchase of wildlife (wild mammals, birds, reptiles, amphib-
ians, mollusks, and crustaceans) or their products taken or
possessed in violation of Federal, State, or foreign laws or reg-
ulations issued pursuant thereto. Section 44, as amended in
1969, provides for labeling (or otherwise identifying con-
tents) of packages containing wildlife transported in inter-
state or foreign commerce. Penalties are provided for
violation of Sections 42, 43, 44, or any regulation issued
thereunder.
Convention Between the United States and Great Britain
(for Canada) for the Protection of Migratory Birds, 1916
(39 Stat. 1702).-This treaty adopted a uniform system of
protection for certain species of birds which migrate between

the United States and Canada, in order to assure the pres-
ervation of species either harmless or beneficial to man;
sets certain dates for closed seasons on migratory birds;
prohibits hunting insectivorous birds; allows killing of birds,
under permit, when injurious to agriculture. Implementation
of the treaty was accomplished by enactment of the Migratory
Bird Treaty Act in 1918.
Migratory Bird Treaty Act (1918), as amended (16
U.S.C. 703-711).-Implements treaties with Great Britain
(for Canada) ratified in 1916, and Mexico ratified in 1936,
for protection of migratory birds whose welfare is a Federal
responsibility; provides for regulations to control taking, sell-
ing, transporting, and importing migratory birds and provides
penalties for violations.
- 1920 to 1929 -
Federal Power Act (1920), as amended (16 U.S.C. 791a-
825r) .-Provides for cooperation between the Federal Power
Commission and other Federal agencies in the investiga-
tion of proposed power projects, and for other agencies to
provide information to FPC upon request. Provides that
licenses issued by the FPC for hydroelectric projects within
Indian Reservations and lands in national wildlife refuges,
etc., that are withdrawn from the public domain must con-
tain conditions that the Secretary of the Interior may require.
Requires a Commission finding before approving private
hydroelectric applications, that the project is best adapted
to a comprehensive waterway development plan for all public
