                     ORDER GRANTING EXEMPTION

   By order 74-5-36 (May 8, 1974), the Board granted Mackey exemp-
 tion authority which permitted the carrier to use prop-driven aircraft of
 up to 90 seats in scheduled service in 17 Florida-Caribbean markets. I In
 that same order, however, the Board denied Mackey's request for
 authority which would have permitted it to use 90-seat aircraft in
 charter service between points in Flotida and points in the Bahamas.2
 The Board found that Mackey had failed to justify its request for
 charter authority. Mackey has now filed a new application, with accom-
 panying evidentiary material, requesting the beforementioned charter
 authority.
   In support of its request, Mackey states, inter alia, that subsequent to
 order 74-5-36 Mackey obtained and put into operation in particular
 scheduled service its DC-6B aircraft, and it has experienced a substan-
 tial and increasing volume of large-group charters and charter requests
 which require numerous extra sections on its 44-seat aircraft.:' The
 carrier alleges further that because of its inability to supply more Con-
 vairs, Mackey has turned down requests for charters too large to be
 operated with one 44-seat aircraft, although it has DC-6B's available
 for charter use. Finally, Mackey asserts that it would be more economic
 for it and better service for its group-charter traffic if it could con-
 solidate its multiple Convair flights on a single DC-6B charter. To il-
 lustrate the demand for larger-aircraft charter operations, Mackey lists
 14 current requests for charter service for groups of between 80 and 250
 persons which it is trying to fulfill by providing extra sections with its
 Convairs. Mackey also submits letters from two charterers. Sun Coun-
 try Resorts and Bahamas Amusements, Ltd., expressing a need for air-
 craft having more than 44 seats.
   Mackey's authority to use 90-seat aircraft in scheduled service was renewed and ex-
 panded to include additional markets by order 75-1-1 (Jan. 2, 1975).
 2By order 71-7-20 (July 2, 1971), Mackey was granted authority to use 44-seat aircraft
 in charter operations between the points in question. That authority has been renewed by
 orders 73-4-14 and 75-1-1.
 :1 During the last 3 months of 1974, Mackey performed 34 charters requiring two or more
 CV-440's. The carrier states that in December alone, it turned down requests on eight
 separate occasions for a second Convair on charters which it operated with one aircraft.
