KEY AIRLINES, INC.  FITNESS INVESTIGATION           Docket  41526


                  ORDER  INSTITUTING FITNESS INVESTIGATION

     On June 9, 1983,  Key Airlines, Inc.  (Key), an air  taxi operator,
filed an application  under Subpart 0 of the Board's Regulations  for a cer-
tificate of public convenience  and necessity to provide  interstate and
overseas charter air  transportation of persons, property,  and mail.  1/  At
the same time, Key  filed in Docket 41527 an application  for exemption
authority to utilize  large aircraft pursuant to an Air Force  contract now
being negotiated.   2/

     No answers have  been filed to the application as yet.   In this
instance expedition  is particularly important in view  of the grant of
exemption authority  to Key for the provision of charter  service to the Air
Force.  Therefore,  we will waive the 28-day answer period  prescribed in
Section 302.1720(d)  in order to set the case for hearing promptly.

     It has been  the Board's consistent policy to require  formal hearing
procedures to  inquire into the fitness of candidates  for initial certifica-
tion where those candidates  are operating carriers  that have not previously
been found fit  and propose a substantial change  in their service.  Although
Key has provided air  taxi service since 1979, it has never  received a fit-
ness determination  from the Board.  Further, the carrier  is proposing to
use B-727 -aircraft in its service.  By this order, we  are therefore insti-
tuting a formal  investigation to determine Key's fitness  to receive a

Force with B-727 aircraft  and to expand later into commercial  charter
operations.
2/   This application  was granted in Order 83-6-77, June  17, 1983.  Key
needed authority  to operate large aircraft before  it could submit its bid
on the DOD contract  on June 20.  If awarded a contract,  Key will not start
the military charter  operations until October 1,  1983.
