92-9-21        48205                JAPAN CHARTER AUTHORIZATIONS:                                               9-10-92

                                   1. We finalixe our tentative decision in Order 92-6-46 to revise
                                   procedures for distribution of the 350 available u.s.-arazil all-
                                   cargo charters for this and future years an set forth in the text
                                   of Order 92-6-46 as modified by this order; I/
                                   2. For the charter year beginning July 1, 1992, we allocate a
                                   portion of the available U.s.-Barazil all-cargo charters to the
                                   following carriers,  Arrow Air, Inc.- 62 charters and Lillon Air,
                                   Inc.-34 charters as discussed in the text of this order;
                                   3.     require each carrier allotted Brazil all-cargo charters to
                                   inform the U.S. Air Carrier Licensing Divicion (P-44), Office of
                                   International Aviation, by letter no later than 14 days after the
                                   srvice date of this order as to how many of the flights in its
                                   advance allotment that it has plans to operate and how many it is
                                   returning to the charter pool; I1

                                   4. The advance allotments in paragraphs 2, above, are subject to
                                   the following condition# Where fewer than 40 percent of a
                                   carrier's allocated charters have been used or been comitted for
                                   use by firm contracts during the ix-month period ending December
                                   31, the rmining charter allotments exceeding the number eqa-l to
                                   the number of those already operated or cotted in the preceding

                                   5. We assign the 254 char-ers not subject to advance allotment in
                                   the 1992/93 charter year to a charter pool for distribution on a
                                   firZt-come, first-served basis, subject to the following
                                   conditions;
                                      (a) For the period July 1 through September 30, only carriers
                                   that have no advance allotments (excluding scheduled carriers
                                   serving Brazil) shall have access to the charter pool;
                                   distributions will be made on   firslt-ccme, first-served basis,
                                   and eligible applicants may operate up to ten charters per month;
                                      (b) Between October I and April 30, all carriers (including
                                   scheduled carriers and advance allotment carriers) may apply for
                                   up to ten charters per Month;
                                      (C) After April 3C, no restrictions apply on the number of
                                   charters that may be applied for each month;

                                      (d) Applications to operate charters may be filed no earlier
                                   than 30 days in advance of the flight date;
                                      (a) Applications must identify the number of flights
                                   requested; proposed flight dates including a four-day service
                                   window; the chartorer(s); the city-pair markets involved by
                                   direction; the type of aircraft to be ued; and the type of cargo
                                   to be transported. After April 30, a copy of the charter contract
                                   must also be filed. (The charter price may be obscured.)
                                   6. We require that each carrier granted advance allotment
                                   charters in this proceeding inform the U.S. Air Carrier Licensing
                                   Division (F-44), Office of International Aviation, by letter, no
                                   later than Janua y 5, of the number Of charters it has operated or
                                   has comitted by firm contracts.  For charters under contract,
                                   carriers shall indicate the charterer(@), dates, city-pair
                                   markets, and nature of the traffic;
                                   7. we require each carrier granted either advance allotment or
                                   pool charters to notify the U.S. Air Carrier Licensing Division
                                   (P-44), Office of International Aviation, no later than the tenth
                                   day of each *onth (or until its charters are exhausted, whichever
                                   occurs first) oft (1) the number of Brazil all-car o charters
                                   operated durin the preceding month; (2) the city pairs served, by
                                   direction; (3) the date of each flight; (4) the charteer(s);
                                   (5) the type of aircraft used; (6) the type of cargo carried; and
                                   (7) the number of charters for wthich Brazilian authority wae
                                   obtained for that month which subsequently wa* cancelled or
                                   rescheduled. Carriers with advance allotment charters shall
                                   notify the Department whether or not any Charters have been
                                   ,operated bv the carrier during the month. After April 30, each
                                   carrier allocated flights from the charter pool would be required
                                   to report such operations no later than seven days after operation
                                   of each flight obtained from the charter pool;
