Application of

    NORTH WEST TERRITORIAL AIRWAYS LTD.        Docket 46227

 for an emergency exemption under
 section 416(b) (7) of the Federal
 Aviation Act of 1958, as amended


                     ORDER GRANTING EXEMPTION

In this order we confirm our March 31, 1989, action granting
North West Territorial Airways Ltd. (NWT), a foreign air
carrier of Canada, exemption authority to conduct an emergency
cabotage flight to support the oil spill clean-up operations
currently taking place at Valdez, Alaska.
Application

By application filed March 31, 1989, NWT requested an emergency
exemption under section 416(b) (7) of the Act to permit it to
operate one one-way cargo charter flight between Los Angeles,
California, and Anchorage, Alaska, during the period
March 31-April 1, 1989, using Lockheed L-100 aircraft. I/ In
support of its request, NWT stated that the flight would be
operated under a contract with Exxon Corporation, and would
carry oil spill clean-up equipment, consisting of two skimmer
boats, flotation equipment and a boom assembly. It stated that
this outsized cargo could be accommodated only on nose-loading
B-747 freighter or L-100 aircraft; that no U.S. carrier
operating these types of equipment had availability during the
time period involved; and that immediate shipment of this cargo
was critical to support the oil spill clean-up operations being
conducted by Exxon at Valdez.



i NWT holds a foreign air carrier permit, issued by
Order 78-5-65, which authorizes it to conduct charter foreign
air transportation of persons and property between points in
Canada and the United States, subject to the provisions of our
regulations governing charters.
