               ORDER STAYING CERTIFICATE REVOCATION


On June 21, 1988, by Order 88-6-26, we revoked the section 401
certificate of New York Airlines, Inc., 1/ for dormancy according
to the provisions of section 204.8 of the Department's Regulations
(14 CFR 204.8). 2/ That action was taken on the basis that, as a
result of its merger with Continental Airlines, New York Airlines
had surrendered its FAA Air Carrier Operating Certificate on
January 3, 1987, and had not operated in its own name since that
time. Under the terms of the order, the revocation action was
to become effective ten days from the service date of the order
unless a petition for review was received or the Department gave
notice that it would review the order on its own motion.


1/ New York Airlines was issued a section 401 certificate
authorizing it to conduct interstate and overseas scheduled
passenger air transportation by Order 80-12-57 (Docket 38686)1
that authority was reissued by Order 81-12-131 (Docket 40208).
2/ Section 204.8, as amended effective December 8, 1986, provides
that the authority of any carrier holding a certificate of public
convenience and necessity under section 401 shall be revoked if
the carrier has not operated for a one-year period under any
authority for which it was found fit, willing, and able.
