Issued by the Department of Transportation on the 1st day of August, 1985 Agreement adopted by the Tariff : SERVED AUG 6 1985 Coordinating Conferences of the : Docket 43263 International Air Transport R-1 through R-8 Association relating to South : Pacific cargo rates 4- ORDER Various member carriers of the International Air Transport Association (IATA) have filed an agreement 1/ ith the Department under section 412 of the Federal Aviation Act of 1958 (the Act) and Part 261 of the Department's Organizational Regulations. It was adopted at the Composite Meeting of Cargo Tariff Coordinating Conferences held in Geneva during May and June 1985. The agreement would establish a new South Pacific cargo rate structure for effect October 1, 1985, through September 30, 1986. In general, ex-U.S. minimum charges, general cargo rates (GCRs) and specific commodity rates (SCRs) would be held at current levels, although ex-Seattle minimum charges and GCRs would be increased by 40 percent and three to four percent, respectively, 2/ and SCRs to French Polynesia and New Caledonia would be increased by five percent. Ex-U.S. contract charges, moreover, would be increased by five percent to Australia and seven percent to New Zealand, and U.S.-Australia priority service rates would be reduced from 140 to 120 percent of the otherwise applicable charges. Many rates to the United States would also be held at present levels. 3/ Minimum charges from Australia and New Zealand, however, would be increased by six to 11 percent, and ex-New Zealand GCRs, SCRs and contaiher rates would be increased by about seven percent. Finally, GCRs frm Perth would be reduced to the current Sydney levels. The pirpose of this order is to establish procedural dates and requirements for the submission of carrier justification in support of the agreement and the submission of comments from interested persons. 4/ l/JATA memorandums TC31 Reso7T-ll3 and 0115. 2/ These increases would commonrate Seattle with Portland and, according to YATA, reflect the absence of direct services from Seattle. 3/ Again, most rates to Seattle would be raised to the Portland levels. T/ This procedure is consistent with past C.A.B. practice as highlighted by the Court in Advanced Micro Devices, et al. v. C.A.B., 742 F.2d 1520 (D.C. Cir., 1984).
