for authority to perform one one-way
single entity charter flight in
overseas air transportation.


                          ORDER GRANTING EXEMPTION

     On March 23, 1967, Overseas National Airways, Inc. (ONA) by telephone
requested and was granted an exemption 1/ from sections 401 and 403 of
the Act permitting it to perform one one-way charter flight departing
March 23, 1967, from Buffalo, New York, for San Juan, Puerto Rico, for
the Buffalo High School Teachers Association.

     In support of its request ONA represented that the proposed service
was required due to a mechanical on the aircraft on which the group was
scheduled to travel; and that the flight would be operated with DC-7
aircraft at a charter price of $9,880.

     In view of the emergency circumstances as represented by ONA, and
the Board's previous actions granting exemptions under similar conditions,
ONA was exempted from sections 401 and 403 of the Act insofar as they
would prevent ONA from conducting the operation proposed. The Board
herein confirms its findings that the enforcement of sections 401 and
403 of the Act insofar as they would prevent ONA from conducting the
operation permitted herein would be an undue burden on ONA by reason of
the limited extent of, and unusual circumstances affecting, its operations
and is not in the public interest. It is patent that to require a cer-
tification proceeding would have the practial effect of precluding the
operation of the charter.
