Mr.   REECE,   from  the Committee on Military Affairs, submitted
                             the following

                             REPORT

                        fTo accompany H. R. 7791

  The  Committee   on  Military Affairs, to whom  was  referred the bill
(H.  R. 779) for the  relief of George W.  Gilmore,  having considered
the same,  report thereon  with  the recommendation that it do pass.
  This measure,  introduced  by Mr. Cochran   of Missouri, was reported
favorably  and passed  the  House  in  the Seventieth  Congress.   The
report made  at that  time is made  a part of this report, as follows:

  The Committee on Military Affairs, to whom was referred the bill (H. R. 7051)
for the relief of George W. Gilmore, having considered the same, report thereon
with the recommendation that it do pass with the following amendment:
  Strike out all the language after the enacting clause and insert in lieu thereof
the following:
  That  in the administration of any laws conferring rights, privileges, and
benefits upon honorably discharged soldiers, George W. Gilmore, who was a mem-
ber of Company A, Thirty-third Regiment Kentucky Volunteer infantry, shall
hereafter be held and considered to have been mustered in August 1, 1862, to have
served honorably, and to have been discharged honorably from the military
service of the United States as a member of that organization on the 23d day of
December, 1862:  Provided, That no bounty, back pay, pension, or allowance
shall be held to have accrued prior to the passage of this act.
  George W. Gilmore enlisted on August 1, 1862, and served until the latter part
of December, 1862. During this period of service he had a severe spell of malaria
which made him physically unable to continue in the service of the United States
Army.  When  his company was mustered into service he was rejected on account
of physical disability and given an honorable discharge. His name was therefore
not included in the rolls of his regiment, although he had served through the entire
organization period of the company.
  The following report of the department and affidavits give a history of the case
and are therefore made a part of this report.
