REPORT
Of the Committee on the Judiciary ypon the steject of fees charged by
the District .ttorney o/ the southern district of the state of Xew
Pork, in prosecu ions against retailers without licen,9  f-v;c.
APRIL 14, 1818.
Read, and ordered to lie upon the table,
The Committee on the judiciary, who was instructed to inquire, what
fees have been charged and received by the district attorney of
the southern district of the state of New York, in prosecutions
brought by him against retailers of spirits, for vending them
without license, and also what fees have been received and
charged by the other officers of the United States, in the said
southern district of the state of New York, and who was further
instructed to prepare and report a bill of fees for the officers of
the United States, in the courts of the United States,
REPORT:
That these subjects were brought to the attention of Congress in
consequence of a complaint made to the Secretary of the Treasury
by certain citizens of New York, coutained in a letter addressed to
Jonathan Fisk, Esq district attorney of the said state, which i sub-
joined to this report. The committee thought it due to Mr. Fisk to
give him information of the matters alleged against him, and acto d-
ingly did so; whereupon Mr. Fisk appeared before the committee and
gave such answers and explanations as he thought proper. After the
return of Mr. Fisk to New York, he transmitted to the committee a
written justification of himself, which is also anndxed to this report;
so thatthe house may have a full view as well of the allegations made
ag.inst the official conduct of the district attorney, as of his reply
to them.
In relation to the costs or fees charged by the attorney in the
cases complained of, the committee finds that one of them, to wit, the-
charge of 17 dollars on the Ileution for a remission t f a penaltv, is al-
lowed by no law of the United States, or the state of New York; but
is entirely defended on an uncertain and limited usage, whose origin
