CENIETERY FOR USE OF INDEPENDENT ORDER OF ODD
              FELLOWS, CENTRAL CITY, COLO.


                 JANUARY 13, 1904.-Ordered to be printed.


  Mr.  BARD, from  the Committee   on Public  Lands, submitted the
                              following

                           REPORT.
                         [To accompany S. 763.]

  The  Committee   on  Public Lands,  to whom  was  referred the  bill
(S. 703) setting apart a tract of land to be used as a cemetery by the
Independent  Order  of  Odd  Fellows, of Central City, Colo., respect-
fully report as follows:
  The  purpose of the bill, as amended by the committee, is to set apart,
to be used as a cemetery by the Independent  Order  of Odd   Fellows,
of Central City, so much of  the tract of land, containing 6.61 acres,
particularly described in the bill, as may be not included in any prior
valid claim, and which is now in the use and occupation of said asso-
ciation.
  The  committee respectfully propose the following amendments:
  Strike out all of lines 3 to 10, inclusive, and insert in lieu thereof-
  That the Secretary of the Interior be, and he is hereby, authorized to set apart
from and out of the mineral lands .in Eureka Mining District, Gilpin County, State
of Colorado (such lands having been heretofore returned to the Land Office at Cen-
tral City as mineral lands), a tract of land not exceeding seven acres in extent, to
be used by the Independent Order of Odd Fellows, of Central City, Colorado, as a
cemetery, and being all that portion of the following described tract not included
in any prior valid claim, namely:
  The  proposed  amendments   are substantially the saie as those rec
ommended   by the Secretary of  the Interior in his letter of December
12, 1903, addressed to the chairman of the Senate Committee on Public
Lands, which  reads as follows:
                                      DEPARTMENT OF THE INTERIOR,
                                          Washington, December 12, 1903.
  SIm: I have the honor to acknowledge the receipt, by reference from your com-
mittee for views, of a copy of S. 703, entitled  A bill setting apart a tract of land to
be used as a cemetery by the Independent Order of Odd Fellows of Central City,
Colorado.
  In answer I inclose a copy of the report on the bill by the Acting Commissioner
of the General Land Office, under date of the 9th instant.
