Mr. DEBOE, from the Committee on Pensions, submitted the following


                             REPORT.

                        [To accompany H. R. 8541.]

  The Committee on Pensions, to whom was referred the bill (H. R.
8541) granting an increase of pension to Mahlon C. Moores, have
examined the same and report:
  The report of the Committee on Invalid Pensions of the House of
Representatives, hereto appended, is adopted and the passage of the
bill is recommended.
  The House report is as follows:
  The records of the War Department show that this officer, now 64 years of age,
served as second lieutenant in Company H, One hundred and eightieth Ohio
Infantry, from August 16, 1864, and as first lieutenant from October 5, 1864, and
that he was mustered out with his company July 12, 1865, and the medical records
of that Department show that he was under treatment in hospital at Nashville,
Tenn., from November 26 to December 8, 1864, for jaundice.
  He first applied for pension on March 15, 1888, on account of a left hernia, piles,
and stomach and liver trouble, and was pensioned in 1889 on account of hernia and
pi les of accepted service origin at $17 per month (total of rank of first lieutenant)
from the date of the filing of the claim.
  On October 22, 1890, the soldier filed another claim on account of deafness of both
ears as a result of a cold contracted in the service, and this claim, as well as that
based upon disease of the stomach and liver, was rejected after a special examination
in July, 1899, that on account of deafness upon the ground of no record in the War
Department and the claimant's inability to show origin in the service and existence
after discharge, and that on account of disease of stomach and liver upon the ground
of inability to show existence of these disabilities at discharge and for many years
thereafter.
  This rejection was affirmed by Assistant Secretary Campbell under date of
July 13, 1900.
  The records of the War Department, as stated above, show that this officer was
under treatment for jaundice, a symptom of liver disease, in 1864, but the testimony
obtained upon special examination as to disease of stomach and liver was mainly
based upon the complaints of the officer, and no competent evidence as to the
existence of these disabilities prior to 1880 is with the case.
  Subsequent to the affirmation of the denial by the Department the officer filed the
testimony of the assistant surgeon of his regiment to the effect that he treated the
officer several times between November, 1864, and July, 1865, for stomach and
bowel difficulty; also the testimony of several comrades that in December, 1864,
the officer had a sallow and sickly appearance; and the testimony of some acquaint-
ances that upon his discharge from the service the officer had a bad color, was eot
