It is hereby stipulated ,nd agreed by and between the said complainant and the said defendant, in the above entitled cause, by their solicitors of record respectively thereunto au- thorized, as follows : The said parties having given notice to each other respect- ively, under and pursuant to rule 67 in equity, and each of said parties hereby acknowledging to have received notice from the other, in accordance with said rule, to the effect that it desires the evidence to be adduced in the above mentioned cause to be taken orally ; and it being further the desire, as well of the said complainant as of the said defendant, that certain evidence to be taken and adduced in said cause shall be taken in the City of New York, it is therefore stipulated and agreed by and be- tween the said parties respectively : That Wheeler H.
