1. LEG AL QUESTIONS IN THE CASE.
1. The constitutionality of Act 173 of the Laws of Mich-
igan of 1901, providing for the taxation of railroad com-
panies on an ad valorem basis.
2. The right of the complainants to an injunction re-
straining the collection of so much of the tax imposed upon
them as rests upon a valuation in excess of the percentage
of true cash value at which other property of the State is
assessed, the rate imi oqed upon the railroads being the
average rate paid upon such other property.
