    Senate of Michigan

           SITTING AS A COURT OF IMPEACHMENT FOR THE

               TRIAL OF MICHAEL E. NOLAN

          JUDGE OF PROBATE FOR THE COUNTY OF GOGEBIC.


                                              Lansing, Friday. April 30, 1943.

  At the hour of 12 o'clock noon of this day, and immediately after the final
adjournment of the Legislature. the Senate of the State of Michigan, pursuant to
the requirements of the Constitution of the State, and Act No. 62 of the Public Acts
of 1872. convened for the trial of Michael E. Nolan, Judge of Probate for the County
of Gogebic. who has been impeached by the House of Representatives under the
provisions of Article IX of the Constitution for alleged crimes and misdemeanors,
and alleged corrupt conduct in office.

  The roll of the Senate was called by the Secretary.

  Present:  Senators Baldwin. Bishop. Blondy. Bonine. Cloon. DeFoe, DeLano,
Diggs. Hittle, Howell. Johnston, LaFramboise, Logie, McCallum, McKee, McLaugh-
lin. Munshaw, Nichols, Nowak, Porter, Rawson, Reid, Saur, Smith, Wilkowski,
Youngblood-26, a quorum.

  Absent without leave: Senators Burritt, Carpenter, Milliken, Tripp, Vander-
Werp and Wood-6.

  The oath required by law was administered to the Hon. Eugene C. Keyes,
President of the Senate, by the Secretary.
  The President administered the oath to the Senators enumerated above as
present.

  The President announced that all the Senators persent having taken the oath-
prescribed by law, the Senate was duly organized as a Court'of Impeachment,
for the trial of Michael E. Nolan.

  Mr. McCallum moved that the absentees without leave be excused from today's
session.
  The motion prevailed.

  Mr. Baldwin moved that a committee of three be appointed to notify the
managers on the part of the House of Representatives, that the Senate is now
organized for the purpose of proceeding to the trial of the impeachment of Michael
E. Nolan.
  The motion prevailed.

  The President appointed as such committee, Senators Munshaw, Cloon and
McCallum.

  Mr. Baldwin moved that the rules adopted by the Senate for the procedure and
practice in trials of impeachment, be adopted by the Senate sitting as a court for
the trial of Michael E. Nolan.
  The motion prevailed.
