POINTS OF PLAINTIFF-RESPONDENT
There are two identical appeals herein (fols. 1481-
1492 & i496-15O8) from certain portions of a judg-
ment of the Supreme Court entered in the Tompkins
County Clerk's office, July 23rd, 1903 (Jo/s. 1341-
14o2), after a trial before the court without a jury.
These appeals neither relate to nor affect any part of
the judgment determining the rights of the ilaintiff-
respondent; nevertheless he has been a party to each
of them.
Statement
The action was brought to foreclose a pledge of
securities held by the plaintiff-respondent; and also
to procure a determination of conflicting claims to
the surplus made by three defendants; i.e., the appel-
lant, Frederick W. Cameron, as assignee, etc.; the
appellant, Pennington Whitehead, as receiver, etc.;
