Mr. Francis Biggins, &c.
SIR,
IN Obedience to your Commands, I have fent you a full and impartial Ac-
count of the late Proceedings againft Mr. Higgins ; and I have alfo obfer-
ved your Direfions in annexing the Prefentment, with the other Papers
which were Confequent to it, that there might be no Interruption in the
enfuing Narrative.
That fome Profecution of Mr. Higgins was refolv'd on before the Seflions, is
highly probable from feveral Difcoveries that were made during the TRYAL;
fome Juftices, who feldom attended at any other time, appeared at this Seflions,
and Mr. Clotworthy vpten, a Presbyterian Elder of another County, allifted on
this Occafion.
Befides the particular Malice of the Party to Mr. Higgins, they were of late
provoked by the-Difgrace of fome of their faft Friends, Three Fadious Juffices,
in vls'er, were for feveral illegal Prafices on a Publick Hearing, Superceded
by the Lord Chancellor, and their Abetters watch'd the firft Opportunity to
make a Reprizal..
To this end, at the ufual Entertainment of the Seflions held at Kilmainham
the 4th of OlIober, 1711. feveral Healths were propofed; to fome of which, Mr.
Higgins made, (as he thought) neceffary Amendments, which as will appear by
the courfe of the Evidence, were laid hold on as the Occafion of the enfuing
Quarrel and Prefentment.

7ury, waited on the Lord Chancellor with it. They urged, Lau Grace, Efq;

That an Application from fo Great a Body, was fufficient ley.
Reafon to remove Mr. Higgins from the Commiffion of the
Peace. His Lordfhip told them, That tho' he bad a due regard to fuch
an Application, yet Mr. Higginv was a Juftice of Peace, he cou'd not con-
demn him Unheard, and that he wou'd appoint a Day for a publick
Hearing ; but they rejected the Offer, and expreffed their Surprize, that his
Lordfhip fhou'd diftrua the verbal Teflimony of Ps many Gentlemen of Qxality and
Honour.
The next Day the Lord Chancellor laid the Prefentment before the Lord Lieu-
tenant and Council, who on mature Deliberation refolv'd to confider the Alle-
gations contain'd in it, and commanded Mr. Higgins to put in his Anfwer.
This Refolution alter'd the Meafiires of the Managers, they pretended Igno-
rance of it, and went again to the Lord Chancellor in a greater Body to pray a
Hearing before him. His Lordfhip told them, That they having declin'd his
Judgment, he had laid the Prefentment before the Lords of the Council, who
wou'd givethem due Notice of the Day of Tryaland Indulge them intime if they
were not prepar'd for it.
