Writ of Error to the Court of Oyer ann Terminer and Quarter
Sessions of the Peace, for the City and County of Philadelphia.
Returnable first Monday of January, 1869.  Exit, Dec. 4, 1868.

HISTORY OF THE CASE.
This Case was an action of debt brought on a forfeited recogni-
zance in the Court of Quarter Sessions, at the suggestion of Andrew
Haustetter, Prosecutor, to February Session, 1865, No. 1, said
Prosecutor in the Court below, was defeated by a judgment of sail
Court, on a demurrer filed by his Counsel, and judgment entered
against the Commonwealth on said demurrer. A Writ of Error was
brought to said judgment of the said Court, which judgment was
reversed by this Court, and judgment entered for the Common-
wealth. The record w as remitted to the Court below.  Execution
issued against 0. Schick, against whom alone judgment had been
