DREXEL, who have survived FRANCIS M. | DREXEL, deceased, late trading as DREXEL & CO., and STEPHEN COUL- TER, defendant8. 9 Your orator complains and says as follows, viz., 1st. He is assignee of the National Safety Insurance and Trust Company, a corporation incorporated by an Act of April 17th, 1841, and the supplements thereto. Said Company, whose business had been for many years prior to the 18th day of April, 1861, that of a Savings Fund, inviting and obtaining deposits from all classes, and which had been long prior to that date utterly insolvent, on that day made an assignment for the benefit of its creditors to Henry L. Benner, its President, the defendant, Stephen Coulter, and one John Derbyshire. The said John Derbyshire declined to act, the said Benner and Coulter were dismissed by the Court of Common Pleas, and your orator was appointed by said Court in their stead, gave bond in due form, and entered upon the duties of said trust. 2d.
