To the Honorable, the Judges of the Court of Common Pleas of the County of Philadelphia.-Sitting in Equity. The City of Philadelphia respectfully represents: That your petitioner is the devisee of Stephen Girard, late of the City of Philadelphia, merchant and mariner, of several tracts of coal land situate in Schuylkill and Columbia Counties, in the State of Pennsylvania. That the Will of Stephen Girard, the testator, is dated February 16, 1830, and contains the following provisions relating to his real estate in Pennsylvania: XVIII. I charge my real estate in the State of Pennsyl- vania with the payment of the several annuities or sums following, (the said annuities to be paid by the Treasurer or other proper officer of the City of Philadelphia, appointed by the corporation thereof for the purpose,) out of the rents and profits of said real estate hereinafter directed to be kept constantly rented.
