Counter Statement and Argument of Allin Robiveti, one of
the Credi'ors of Philip C. Donnelly, deceased.
Since the Exceptant, Catharine Donnelly, Admitistt-ariix
of Philip C. Donnelly, deceased, printed her first paper boqk,
her counsel, (understood to be her -on, Ignatius lonnell,
Esq.) has printed a second paper book, consisting of 49 pages.
It is so full of misstatements, gross inaccuracies and gratui-
tous assertions, totally unsupported by evidence, that it is
difficult to answer it.  The exceptions of the accountant are
vague and indefinite, and if necessary -night be rejected by the
Court as inconsistent with the settled law and their practice,
yet the auxiliary argument does not pretend to confine itself
to these exceptions, but introduces matters entirely new and
inconsistent with the ground heretofore assumed by the ac-
countant in this controversy. The fulsome panegyric upoa
the widow with which it groans might be excused if it were
not as illtimed as it is unmerited. It is unpleasant to speak
either of the dead or the living in the shape of accusation, but
justice to other parties requires the truth to be stated, and
it is consolatory to know that the accountant and her junior
counsel, have provoked and rendered it necessary on the
present occasion. A brief statement of the facts will render
the case more intelligible to the Court.
