THE BucK MOUNTAIN COAL COMPANY,
vs.                     In Equity.
HARRY CONRAD AND THOMAS K. CONRAD. I
THE SEPARATE ANSWER OF THOMAS K. CONRAD TO THlE
BILL OF COMPLAINT OF THE SAID BucK MOUNTAIN COAL
COMPANY.
This respondent in answer to said bill saith: That he has
been advised that he is not bound by law, to make any
answer unto said bill of complaint.
That the same contains no interrogatories or note appended
to said bill as required by the rules and practice of the
Court.
That the several matters stated in said bill do not entitle
the complainants to any relief in Equity, and that for any
supposed injury they might conceive themselves entitled to
make complaint of, they have a full, complete and adequate
remedy at law, to which they have already resorted.
That this respondent has the right to call upon complain-
ants to elect which of the two suits brought by them, they
will pursue.
And that for these and other reasons, the complainants
have no right to call upon this respondent to make any an-
swer to said bill. But this respondent not desiring to avail
himself of any objections to the form of this proceeding, or
of any of the errors or imperfections in said bill contained,
and in justice to his character, expressly waiving all and all
manner of technical defence. He answering, saith:
That it is wholly untrue, and he therefore denies that on
or about October, 1857, or at any other period the said
