APPELLANT'S PAPER BoOK.
This case comes up on an appeal from the decision of the
Court below, sustaining the Report of William D. Baker, Esq.,
Auditor, appointed to audit, settle, and adjust the account of
Henry D. Welsh, Administrator de bonis non cum testamento
annexo of the estate of John J. Hess, deceased.
John J. Hess, the appellant, is the son of John J. Hess,
deceased, and in the Court below the appellant appeared as the
exceptant to the Auditor's Report.  0
HISTORY OF THE CASE.
John J. Hess, a man of considerable means, died several
years prior to the year 1854, leaving a Will, and appointing B.
B. Stimble his Executor. Henry Welsh afterward became Ad-
ministrator de bonis non cum testamento annexo, and his account,
filed August 17, 1860, was the one before the Auditor.
