The Answers of CLAYTON FRENCH to the interrogatories filed
by JAMES HENRY, Complainant.
I. To the first interrogatory, I answer that said mortgages
were assigned by complainant to said John E. Morey as col-
lateral security for the indebtedness of complainant to the
firms of French & Richards, and French, Richards & Company.
II. To the second interrogatory, I answer that to the best
of my knowledge and belief Myers and Hartranft had partially
erected a house on each of said lots, but had not completed
them, and that said houses so left partially erected were not of
sufficient value to cover arrears of ground rent and other en-
cumbrances prior to said mortgages.
III. To the third interrogatory, I answer that French, Rich-
ards & Company did not agree with complainant that they
would not bring suit on said mortgages, or either of them,
until complainant completed the said houses.
IV. To the fourth interrogatory, I answer that complainant
did not, so far as I know and believe, give to the said firm any
notes on or about May 1, 1858. I cannot remember the
amounts or the dates of notes he gave. His notes were ex-
tended and renewed so frequently that I cannot now give the
dates of them. I never knew him to pay a note at maturity.
The said firm held two notes of said Henry for $545 82
each, and four notes for $681 52 each, all dated July 1, 1858,
and payable six months after date, respectively. For these,
