The answer of SAMUEL 1I. FRENCH to the Bill in Equity,
filed by JAMES HENRY, against CLAYTON and SAMUEL H.
FRENCH.
I, Samuel H. French, defendant above named in answer to
said Bill, or to so much thereof as I am advised it is material
or necessary to make answer unto, do say :
I. I respectfully insist that the said complainant has not in
and by his said Bill, made or stated such a case as entitles
him to the relief thereby sought and prayed for, and I make
answer thereto, reserving all right of objection to the many
errors, uncertainties, and imperfections in said Bill contained.
II. I was not a member of the firm of French & Richards,
with whom said Henry's dealings commenced, and which firm
was dissolved at the end of the year 1855. I became a mem-
ber of the firm of French, Richards & Company on the 1st
day of January, 1856, when said last mentioned firm was
formed. This firm was dissolved in June, 1858, by the death
of said William H. Richards, Jr. The surviving partners
continued in the same firm name to conduct said business until
June, 1859, when the firm was again dissolved by the death
of said John E. Morey. Since then by the introduction of
other partners, a new firm, under the same style, has con-
ducted the business previously carried on by the said firm.
III. The said firm of French, Richards & Company carried
on business at two different places in the City of Philadelphia,
each for a different branch of said business, having separate
books and accounts. One of these was at Tenth and Market
Streets, and was managed entirely by the other members of
