vs. January Term, 1865.
ADOLPH et al.
BILL IN EQUITY.
TO THE HONORABLE THE JUDGES OF THE SUPREME COURT IN
AND FOR THE EASTERN DISTRICT OF PENNSYLVANIA,
IN EQUITY:
John Armor brings this his bill of complaint against Alfred
W. Adolph, Eli Keen, Joseph W. Withers, and Pearson S.
Peterson, trading as Withers & Peterson; David Stuart and
Richard Peterson, trading as Stuart & Peterson; Evan Morris,
John G. Wallis, John O'Byrne, John M. Riley, Joseph J.
Huckel, William P. Hacker; and thereupon your orator com-
plains and says as follows, viz.
The complainant is a citizen and resident of the Territory of
Colorado, to which he went soon after the discovery of gold
therein, and where, except during short intervals of absence,
he has since remained.
By reason of his said residence, and the advantages of infor-
mation, inspection, and opportunity which it gave him, he was
enabled, by much industry and expense of time and money, to
acquire and become the owner of sundry lode claims, acquired
originally by discovery, pre-emption, tunnelling, or otherwise,-
some of them developed and some of them undeveloped,-and
also a mill site; which lode claim and mill site were and are of
very great value.
The complainant refers to the Schedule A, annexed to the
contract hereinafter referred to, and marked AA, as contain-
ing a list of said properties, describing them shortly, as is cus-
tomary in conveyances of such properties in said Territory.
