THOMAS on oath says, That he is one of the firm of Thomas, Norton & Co., who are creditors of the Corpo- ration defendants to the amount of $10,312 72, and that the Complainants, E. H. Helfrich, N. Petry, J. S. Helfrich, and John N. Tyler, are Stockholders in said Corporation. Deponent further saith, That said Corporation has become wholly insolvent, and utterly unable to carry on any business whatever. That the property, consisting of certain iron works situated in Berks county, in this State, was sold by the Sheriff of that County on the 29th day of July, 1865, under a judg- ment obtained on a mortgage amounting to about $26,100. That the said property realized at said sale but the sum of $30,200. That said Company is now without any organized Board of Directors, and numerous suits are now pending against its Offi- cers for fraudulent transactions with the stock of said Company. Deponent further saith, That there may be a balance of about $4,800 in the hands of the Sheriff after the payment of said mortgage, and deponent greatly fears, that if the same be al- lowed to get into the hands of the Officers of said Company that it may be entirely lost. 13.
