Between JoHN II. MORRIS, JOHN T. HAMPTON, and DAVID C.
ANDREWS, Plaintiffs,
And
TnOMAS STEERS and JOSEPH C. HERR, Defendants.
To the Honorable the ,Judges of the said Court:
Your orators complain and say :
1. That in the month of December, A.D., 1864, the plain-
tiffs together with the defendants, Thomas Steers and Joseph
C. Herr, all of the said party except the said Hampton, being
then present in the State of West Virginia, agreed to purchase
from one Simeon Thornton, a tract or piece of land, situate in
the County of Wirt, in the State of West Virginia, on the
south bank of Hughes river, containing two hundred and sixty-
five acres or thereabouts, together with a three acre lot on the
opp6site side of the river, for the price of twenty-seven thou.
sand five hundred dollars.
2. That the interest of said purchasers in said land was to
have been as follows : One-third to Thomas Steers, one-third
to Joseph C. Herr, and one-third to these plaintiffs, who were
to pay for the said land in the same proportions.
3. That by the agreement of purchase and sale, nine thou-
sand dollars was to be paid in cash, nine thousand dollars in
one month, and nine thousand dollars in two months.
4. That the said land was so purchased by the said parties
