This case comes up on a Habeas Corpus and a Certiorari,
the object being to test the constitutionality of the Act of
Assembly passed the 13th, day of March, A. D. 1862, of
which the following is a copy.
An Act to authorize the arrest of Professional Thieves, Burg-
lars, et cetera, in the City of Philadelphia.
SECTION 1. Be it enacted by the Senate and House of
Representatives of the Commonwealth of Pennsylvania in
General Assembly met, and it is hereby enacted by the
authority of the same, That from and after the passage of
this Act, if any person shall be charged on oath or affirma-
tion before the mayor or police magistrate of the central
station of the City of Philadelphia, with being a professional
thief, burglar, or pickpocket, and who shall have been
arrested by the police authorities at any steamboat landing,
railroad depot, church, banking institution, brokers' office,
place of public amusement, auction room, store or crowded
thoroughfare in the City of Philadelphia, and if it shall be
proven to the satisfaction of the said mayor, or police magis-
trate appointed by the mayor for the central station, by suf.
ficient testimony that lie or she was frequenting or attending
such place or places for an unlawful purpose, he or she shall
