To the Honorable the Judges of sa?'d ('out:
Your orators complain and say:
I. That the said defendant has commenced suit in this
Court against plaintiffs for the recovery of certain moneys
alleged to be due to him from plaintiffs for meals, lodginrc
and keep of horses to March Term, 1866, No. 530.
II. That a narr has been filed, and issuable pleas filed
thereto, and the case is now, as plaintiffs are informed and
believe, at issue.
III. That the meals, lodgings, keep and items comprising
the claim in this case were not supplied, nor was any part
thereof supplied or furnished to or at the request of the
plaintiffs herein, or any authorized agent of the plaintifi>
herein, or for the benefit of the plaintiffs herein, and that
they are in no way liable therefor.
IV. That said items comprising the claim of defendant
in this bill were furnished by himself at the instance and
