In the matter of the appeal of Thomas L. Woolston, from the de-
cree of the Court of Common Pleas of Bucks County, confirming the
report of the Auditor in the distribution of the proceeds of real
estate in the case of

The following facts were agreed upon by the parties, which give a
full history of the case :
On the 17th of July, 1861, judgment was entered in the Court of
Common Pleas of Bucks County on Test. Fi. Fa. from the District
Court of the city and county of Philadelphia, Thomas L. Woolston
vs. Benjamin Rush Plumly, for the sum of $2160.00 with costs, and
interest from May 28th, 1861. Judgment Docket No. 14, page 652 ;
No. 298, April Term, 1861. Under a writ of Alias Test. Fi. Fa.,
(same parties) issued out of the said District Court, bearing date 11th
of Sept., 1861, John T. Simpson, High Sheriff of Bucks county, levied
upon a house and lot in Attleborough, said county, which, having been
