THlE CITY OF CARONDELET
VS.
THE UNITED STATES.
To the Honorable the Court of Clais:
Your petitioner, the City of Carondelet, respectfully
prays that an appeal may be granted it from the judg-
ment and decree rendered herein to the Suprenie Court
of the United States, and that this court will certify as the
record in this cause in addition to the pleadings, the de-
cree and rulings of the court, the following statement of
facts, and of the evidence and points ruled-that it may
appear by the record so certified to the Supreme Court
what points were decided by this court in the hearing and
decision of this cause, according to the statute and rules
of court in this case made and provided.
That it may appear what points were decided by the
court and what questions arise in this case, it is necessary
that the facts which the evidence establish should be
stated ; and as a part of the exceptions of the claimant
arise upon an alleged incorrect finding of facts, it is neces-
sary and proper that the evidence, so far as it relates
thereto, should be set out. And your petitioner prays
the court to certify also to such facts, questions, and evi-
dence.
To maintain this claim against the United States the
claimant undertook to prove that it had a valid title to
the land in question under the act of Congress of 13 June,
1812, and that as that act failed to designate the lands in
question but provided for such designation by authorizing
