Statement of the Case and Argument on the parl of the
Claimant.
This chse has been already once argued before this Court.
In January, 1861, I had the honor of submitting a reply to
the printed answer of the solicitor to the argument of the
leading counsel for the claimant, (the present Posmaster-Gen-
eral of the United States.) My reply was hasty, and, though
perhaps sufficiently responsive to the objections indicated by
the solicitor, did not satisfactorily embrace the whole subject.
It is absolutely impossible to grasp the question presented by
the record without some familiarity with the past history of
the Spanish Province of Louisiana-its laws, usages and cus-
toms-the treaty by which the United States acquired it-the
manner in which Congress proceeded to fulfill the obligations
of the treaty of cession, and the interpretations of the various
acts of Congress on this subject by the Supreme Courts of
Missouri and the United States. On a review of my argu-
ment, made in 1861, it has occurred to me that I committed
the error of supposing that matters of a provincial nature-ne-
cessarily familiar to any one who has been during the last
twenty years largely engaged in the trial of land causes
at St. Louis- were equally interesting to the profession at
large; and that I did not lay the foundation of my argument
as carefully as I should have done. I applied myself to the
objections taken by my adversary, but did not demonstrate,
